RE: The tariff classification of wall sconces from China.

Dear Ms. Venkateswaran:

In your letter dated November 11, 2008, you requested a tariff classification ruling.

The merchandise under consideration consists of three wall sconces identified as SKUs 7450208, 7450216 and 7450224. SKU 7450216 is a wood and metal single lamp wall sconce. This sconce consists of a round wood back plate with an outer metal ring. A single metal elbow bracket connects a cylindrical wood post to the back plate. The wood post features a lamp-holder with a standard Edison base socket. This sconce is imported with a fabric shade over a metal frame which attaches directly to the lamp-holder. SKU 7450208 is a double lamp wall sconce and SKU 7450224 is a triple lamp wall sconce. These two fixtures are constructed in the same manner as the single wall sconce with a combination wood/metal back plate, metal support arm and wood post with lamp-holders. As with SKU 7450216, the double and triple lamp wall sconces are imported with fabric shades over metal frames which attach directly to the lamp-holders.

The applicable subheading for the three wall sconces (SKUs 7450208, 7450216 and 7450224) will be 9405.10.8010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Lamps and lighting fittings…: Chandeliers and other electric ceiling or wall lighting fittings…: Other: Household.” The general rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
